Rodrigo Duterte, former President of the Philippines, will remain detained in the Netherlands, as confirmed by the International Criminal Court (ICC) after judges denied his provisional release request. The 80-year-old leader faces severe accusations of crimes against humanity linked to his contentious “war on drugs” during his presidency and earlier tenure as mayor of Davao City.
The ICC noted that these charges relate to alleged extrajudicial killings that occurred from November 1, 2011, during Duterte's mayoralty, to March 16, 2019, just before the Philippines formally withdrew from the court. Reports indicate that these actions targeted thousands, primarily from impoverished backgrounds, suspected of drug-related offenses. While Duterte has categorically denied sanctioning these killings from 2016 to 2022, he did advocate for police to use lethal force against resisting drug suspects. Human rights organizations, including Amnesty International, assert these orders have been linked to numerous deaths.
Earlier this year, Duterte was arrested and moved to the Netherlands, where he remains in ICC custody. His legal team argued for his provisional release on medical grounds, citing deterioration in his health. However, the Appeals Chamber upheld the previous ruling to keep Duterte detained, with presiding judge Luz del Carmen Ibanez stating the defense failed to substantiate any missteps in the earlier decision.
Duterte did not attend the ruling. His attorneys plan to file a follow-up request for release after a comprehensive medical evaluation next month, emphasizing the urgency surrounding his health concerns.
Duterte’s threats towards drug suspects and the endorsement of violent policing measures during his administration sparked intense debates both locally and globally. Reports indicate that thousands of drug offenders were killed under these policies, leading to criticism from international human rights entities and governments.
