Vietnam Introduces Regulations for Forensic Technology Exams

Vietnam has rolled out fresh guidelines that govern forensic examinations in science and technology, as announced in a circular from the Ministry of Science and Technology. This initiative aims to enhance the integrity of legal processes and ensure that qualified personnel manage scientific and technical inquiries.

The circular delineates forensic examination as the evaluation of specialized matters managed by the Ministry and local authorities. It encompasses various domains including innovation, digital technology, telecommunications, intellectual property, quality control, among other scientific sectors.

According to the new rules, forensic experts must fulfill rigorous criteria set by the Law on Forensic Expertise. This includes demonstrating strong moral integrity, possessing at least a university degree, and having no less than five years of relevant professional experience.

In exceptional scenarios, individuals directly engaged in forensic tasks might qualify with a minimum of three years’ practical experience. Additionally, all candidates are required to undergo training in legal knowledge and forensic methods prior to appointment consideration.

The circular specifies that educational credentials must be recognized under Vietnamese law, including degrees obtained from both domestic and international institutions. Experience requirements should be closely related to the field of expertise and calculated from the employment start date to the application submission.

A clear process for appointing forensic experts and issuing formal certification has been established. The Ministry of Science and Technology will appoint experts at the national level, while provincial authorities will manage local appointments.

This procedure includes application reviews, evaluations from pertinent departments, and a final decision by the Minister, all conducted within a specified timeframe. Once approved, lists of experts will be openly shared on official channels for transparency and accountability.

In summary, this new circular is anticipated to elevate the standard and reliability of forensic examinations in the fields of science and technology, thereby bolstering legal processes and fostering confidence in technical investigations throughout Vietnam.
