Vietnam's Land Clearance Regulations for Project Approval

Vietnam has officially delineated the rules governing land clearance associated with construction projects, clarifying the schedule for land acquisition and site preparation relative to project approval. Authorities confirmed that only approved investment projects provide the legal framework necessary for initiating land acquisition, compensation, and site clearance activities.

This announcement addressed prior uncertainties about whether land clearing could commence before formal project approval. According to the Ministry of Construction, current regulations establish a clear order for project implementation that encompasses the stages of preparation, execution, and completion.

As stipulated in the 2014 Construction Law, project preparation materials such as pre-feasibility and feasibility study reports are required to detail land use needs and site clearance strategies. These evaluations are crucial for determining the project's viability prior to granting approval.

Officials have stressed that land acquisition and allocation typically should occur only once project approval is granted and an investment decision is made. This framework ensures that land-related operations correspond with authorized project plans and schedules.

Nonetheless, the legal framework presents opportunities for flexibility in specific instances. According to the Law on Public Investment 2024, authorized bodies can opt to treat land clearance, compensation, and relocation as separate projects. In these scenarios, such activities can proceed independently of the main construction investment project.

This provision facilitates a quicker setup for significant or urgent projects, where prompt land clearance is necessary to keep development on track. It also enhances operational efficiency in project rollout while adhering to legal standards.

In summary, this clarification highlights the necessity of adhering to established procedures in construction investment while permitting certain exceptions to aid timely infrastructure improvement throughout Vietnam.
