Vietnam Empowers Local Authorities for Environmental Inspections

The Vietnamese government has emphasized the authority of local administrations in enforcing environmental laws, confirming that commune-level officials are authorized to inspect businesses for regulatory compliance. This clarification follows inquiries from a garment company in Dong Thap.

The Ministry of Agriculture and Environment indicated that the 2020 Law on Environmental Protection and its amendments distinctly define these inspection powers. Local authorities, including commune-level administrations, are thus empowered to conduct specialized inspections concerning environmental protection.

Under this directive, the Chairman of the People’s Committee at the commune level is tasked with overseeing environmental compliance within their domain, ensuring adherence to environmental standards even at the grassroots level.

This legal framework is further reinforced by additional regulations, including clauses stipulated in the amended laws as well as Government Decree No. 217, issued in 2025. Such legal guidelines help establish clear procedures and responsibilities for effective and transparent inspections.

Officials underscored that all businesses must adhere to environmental laws, irrespective of the inspecting authority. Companies holding environmental permits are subject to continuous monitoring to ensure compliance with established standards.

This clarification is intended to enhance enforcement methods and ensure consistent application of environmental protections across the nation. By empowering local authorities, the government aims to improve oversight and detect violations in their infancy.

Moreover, the ministry reiterated that these steps form part of broader initiatives aimed at fostering sustainable development and preserving natural resources. Enhanced inspection capabilities at the local level are expected to boost accountability and environmental governance nationwide.
