In a significant legal development, the Lucknow bench of the Allahabad High Court has declined to quash the First Information Report (FIR) filed against folk singer Neha Singh Rathore. The FIR pertains to her social media posts allegedly containing derogatory remarks about Prime Minister Narendra Modi, Home Minister Amit Shah, and the Bharatiya Janata Party (BJP) following the Pahalgam terror attack in April 2025.

Court's Observations

The bench, comprising Justices Rajesh Singh Chauhan and Syed Qamar Hasan Rizvi, examined the allegations and found them to prima facie disclose cognizable offences. The court noted that Rathore's posts invoked religious sentiments and accused the government of exploiting soldiers' sacrifices for political gain. The timing of the posts, made immediately after the Pahalgam attack, was also deemed significant.

Directions to Neha Singh Rathore

The court has directed Rathore to appear before the investigating officer on September 26, 2025, and to cooperate with the ongoing police investigation. This includes providing any necessary information and documents related to the case.

Legal Context

While the Constitution of India guarantees the right to freedom of speech and expression under Article 19(1)(a), this right is subject to reasonable restrictions. The court emphasized that expressions that incite hatred or pose a threat to national security fall outside the ambit of protected speech.

The court's decision has sparked discussions on the balance between free speech and national security. Supporters of Rathore argue that her posts were critical of government policies and did not incite violence. However, critics contend that the posts were inflammatory and could have exacerbated communal tensions.
