DMCC and DIFC Courts Strengthen Business Legal Framework

DMCC and DIFC Courts Strengthen Business Legal Framework

Post by : Bianca Haleem

The Dubai Multi Commodities Centre (DMCC) continues to fortify its collaboration with DIFC Courts, aiming to enhance the region's commercial justice landscape.

With the renewed Memorandum of Understanding (MoU), over 26,000 companies registered with DMCC will gain streamlined access to a suite of services offered by the DIFC Courts, including mediation, commercial dispute resolution, wills, and digital economy legal solutions.

This partnership builds on more than ten years of collaboration and seeks to solidify legal certainty for international firms operating in sectors such as trade, finance, technology, and commodities.

H.E. Justice Omar Al Mheiri of the DIFC Courts emphasized the importance of this partnership, allowing businesses to utilize English common law for dispute resolutions in their cross-border agreements, thereby ensuring global recognition of enforcement.

DMCC CEO Ahmed Bin Sulayem remarked that this expanded MoU elevates Dubai’s status as a premier global business center, offering member companies enhanced services including the Digital Economy Court and mediation facilities, ensuring they operate with increased legal assurance.

A notable aspect of this agreement is access to the DIFC Courts Mediation Service Centre, which offers timely and cost-effective dispute resolution, with mediation outcomes carrying similar legal validity as formal court judgments.

Moreover, the DIFC Courts will continue to provide personal and asset protection options. Their Wills Service allows non-Muslim residents and entrepreneurs to register wills for the protection of their assets and interests in the UAE, while the newly launched Digital Assets Wills Service encompasses cryptocurrencies and blockchain assets.

Furthermore, the Digital Economy Court under DIFC Courts will address intricate disputes involving AI contracts, digital assets, and blockchain transactions, crucial for DMCC’s fintech and innovation sectors.

Both entities are set to launch joint workshops, webinars, and educational initiatives aimed at helping DMCC members understand legal services and incorporate DIFC Courts options seamlessly into their business practices.

The agreement also emphasizes the integration of DIFC Courts’ services within DMCC’s platforms, offering tailored advice for businesses entering international contracts.
