The spotlight on Jimmy Lai, the Hong Kong media mogul, intensified Monday as the High Court concluded the final arguments in his national security case. This proceeding marks a crucial stage before the court delivers its sentencing in one of the most scrutinized trials following the implementation of the national security law in Hong Kong.
At 78, Lai, who founded the defunct pro-democracy outlet Apple Daily, has been a longstanding critic of the Chinese regime. He was found guilty in December for conspiracy to collude with external forces and publishing seditious content. These charges could lead to a sentence ranging from a decade to life behind bars. Lai continues to vehemently deny all allegations.
The trial has sparked significant international backlash, with countries including the United States and members of the European Union expressing concerns over press freedoms and the fairness of the judicial process in Hong Kong. In contrast, local officials maintain the trial adhered to legal standards, arguing that the national security law was necessary to restore order following the pro-democracy protests of 2019.
In court, Lai’s attorneys emphasized his advanced age and medical issues, citing conditions like high blood pressure, diabetes, and cataracts. They also noted that he has spent over 1,800 days in solitary confinement, which they contend has exacerbated his health problems. His lawyer warned that each prison day draws Lai closer to the brink of life, despite his conditions being deemed non-life-threatening.
Prosecutors dismissed allegations of significant health deterioration, referencing a recent medical evaluation that deemed his condition stable. They disputed claims of major weight loss, stating that official documents indicate only minimal changes. Additionally, they noted that Lai chose solitary confinement for security reasons.
The presiding judges remarked that Lai leveraged his influence and media to disseminate ideas intended to undermine the Chinese government and jeopardize Hong Kong's order. Other defendants in the case, including former executives of Apple Daily, have sought leniency in their sentences after cooperating with prosecutors and testifying against Lai.
Public support for Lai was visible outside the courthouse, with nearly 100 individuals queuing overnight to secure entry, some even arriving days earlier. Supporters assert that Lai's punishment is politically motivated and hope for his release.
Global attention remains focused on Lai, as UN experts advocate for his release based on humanitarian concerns given his age and health. Recently, U.S. President Donald Trump indicated he discussed Lai’s situation with Chinese President Xi Jinping, labeling Lai a constructive activist, albeit with no resultant response.
The hearing will proceed, with sentencing anticipated shortly. Regardless of the outcome, Jimmy Lai's case symbolizes the ongoing struggle over freedom of expression, legal principles, and political resistance in Hong Kong's evolving landscape.
