UN Rapporteur Calls Out Legality of India-Israel Relations

Francesca Albanese, the UN Special Rapporteur on the Occupied Palestinian Territories, has voiced significant concerns regarding India's established political and defense connections with Israel, indicating that such ties could contravene international law. In an interview, she referenced legal stipulations associated with the International Court of Justice, asserting that these obligations urge nations to refrain from military and trade engagements with states accused of illegal occupation.

Albanese delivered her insights in a report named “Torture and Genocide,” presented to the United Nations Human Rights Council. Within this document, she claims that Palestinians have encountered systemic torture since October 2023, particularly in Gaza, describing the area as akin to a “vast torture camp,” with widespread arrests, including those of minors, and numerous reports of disappearances. It also underscores harsh detention conditions, abuse, and the absence of basic rights.

Regarding India, Albanese cautioned that close ties with Israel, especially in terms of defense and political arenas, might risk violating international obligations. She emphasized that such cooperation could exacerbate what she describes as a larger cycle of violence, potentially undermining the global legal framework regulating international relations.

Moreover, she contended that torture isn’t an isolated phenomenon but part of a broader system. In her perspective, these acts resonate beyond prisons, permeating daily life through surveillance and restrictive controls over movement in Palestinian territories, thereby fostering an environment of persistent pressure and coercion.

Albanese also tied her assertions to the broader theme of global accountability, noting that some nations have begun to counter similar issues through various legal or diplomatic measures. She urged the international community to adhere to legal standards and ensure accountability where violations occur.

Her statements contribute to the ongoing international conversation surrounding the Gaza situation and the duties of countries maintaining relations with Israel.
