EU Initiates Major Investigations into Amazon and Microsoft Cloud Services

The European Commission has commenced three formal investigations into the cloud computing sector within the region, representing one of its most substantial regulatory actions since the implementation of the Digital Markets Act (DMA). These inquiries aim to determine whether Amazon Web Services (AWS) and Microsoft Azure exert a level of dominance that would categorize them as gatekeepers under the new competition regulations.

Although they do not typically satisfy the defined criteria within the DMA, the Commission indicated that the scale and strategic importance of their cloud operations necessitate further scrutiny. Officials observed that both corporations provide crucial infrastructure for numerous businesses throughout the EU, underlining the need to explore whether their market practices could inhibit competition or restrict equitable access for smaller firms.

As part of the investigations, officials will evaluate the structure of cloud services, billing methods, and how customers are integrated into ecosystems, alongside analyzing whether technical or contractual elements impose obstacles for competitors. The Commission also seeks to ascertain if current regulations can effectively prevent actions that might favor certain players within the rapidly evolving cloud industry.

Per the announcement, the three investigations are anticipated to be completed within a year, providing regulators with enhanced insights into the operational dynamics of the EU's cloud market and identifying areas where further oversight may be essential.

Microsoft has expressed its readiness to assist with the inquiry, while AWS argues that the cloud landscape in Europe is robustly competitive and inventive.
