Meta Faces €479m Fine in Spain for Data Misuse

In a groundbreaking decision impacting Europe’s digital ad sector, a commercial court in Spain has mandated that Meta compensate €479 million to a coalition of Spanish digital media entities. This ruling arises from findings that Meta secured an unfair advantage in the Spanish advertising realm by improperly utilizing personal data from users on Facebook and Instagram.

The compensation is set to be allocated among 87 publishers and news agencies, representing one of the heftiest collective demands ever placed on the tech giant within Spain. The court highlighted that Meta’s advertising model—driven by insights into user behaviors and preferences—afforded the company a considerable competitive upper hand over local media competitors who must navigate stricter regulatory frameworks and have restricted data access.

It was underscored that Meta’s handling of data contravened the EU’s General Data Protection Regulation (GDPR), which allowed it to bolster its leadership in Spain’s ad sector. Such actions, the court concluded, have led to a lopsided competitive landscape where compliant publishers found it challenging to thrive.

As of Thursday, there has been no response from Meta regarding the court ruling, and their representatives have yet to reply to requests for clarification.

This ruling arrives amidst heightened scrutiny of the company in Spain. Just the previous day, Prime Minister Pedro Sánchez announced that a committee in the lower house will start an investigation into Meta’s possible privacy breaches, which could affect millions of users on Facebook and Instagram in the nation. The probe aims to evaluate how Meta gathers, processes, and profits from user data.

With both this court ruling and parliamentary investigations underway, Spain seems set to escalate its scrutiny of Big Tech.
