Jim Lai’s Trial: A Reflection of Hong Kong’s Political Shift

Post by : Saif Al-Najjar

Once again, Hong Kong finds itself under international scrutiny as the High Court prepares to deliver its verdict in the protracted trial of media mogul Jimmy Lai. At 78 years old, Lai is a prominent figure in Hong Kong’s pro-democracy movement, having transformed Apple Daily into a potent voice against Beijing’s encroachment. Presently, he faces severe charges stemming from the national security law, which has drastically altered Hong Kong's political and legal environment since its enactment in 2020.

Lai's journey to this critical juncture traces back to 1995, with the founding of Apple Daily. The newspaper garnered acclaim for its daring reporting and steadfast advocacy for democratic principles. However, the landscape shifted dramatically in June 2020 when China imposed the national security law, categorizing actions like collusion with foreign powers as serious crimes punishable by lengthy prison sentences. Shortly after the law's application, Lai was apprehended during a significant police raid on his media headquarters. Although initially granted bail, he faced a series of escalating legal challenges.

In addition to charges relating to the national security law, Lai received multiple prison sentences for his participation in pro-democracy protests in 2019. All the while, his company Next Digital struggled with asset seizures and increasing government pressure. By June 2021, Apple Daily published its final edition, selling one million copies as residents across the city queued early to acquire the last remnants of a publication synonymous with Hong Kong's freedoms.

As time progressed, Lai's legal circumstances became increasingly fraught. In 2022, the Justice Secretary decided to move forward with his national security case without a jury, claiming that foreign involvement could jeopardize the fairness of the proceedings. Multiple delays ensued as the government sought Beijing's ruling on the participation of foreign lawyers. Ultimately, only local lawyers were permitted, effectively barring British attorney Tim Owen from representing Lai.

Despite his attempts to challenge this ruling, Lai found himself without his preferred legal counsel. The trial finally commenced in December 2023, with Lai testifying for 52 days and maintaining that he never aimed to influence foreign policies regarding China or Hong Kong. Spanning 156 days, this trial has become one of the longest and most politically charged legal proceedings in Hong Kong’s history.

Global interest in Lai's case has remained significant. Notably, U.S. President Donald Trump brought up Lai’s plight during a 2025 meeting with China's President Xi Jinping. During the closing phases of the trial, Lai experienced health issues, including heart palpitations, which led to medical interventions.

As the city anticipates the verdict, Lai's case embodies broader concepts of freedom of expression and democratic values. To the authorities, he symbolizes foreign influence and potential disorder. His prolonged legal battle highlights the stark divisions that now characterize Hong Kong’s trajectory.

The ruling expected on Monday will not only determine Lai's future but also signify the direction Hong Kong is taking. It will illustrate how the city is redefining its identity amidst shifting political norms and the extent to which dissent, free expression, and independent journalism can flourish. The global community is closely observing as Hong Kong faces this pivotal moment.
