Vietnam's Enhanced Penalties for Lottery Operations

The Ministry of Finance in Vietnam has put forth a proposal to introduce stricter administrative penalties within the lottery sector. This initiative is encapsulated in a draft decree focused on refining and updating current regulations to boost enforcement and oversight.

Among the changes, the existing Decree No. 98/2013/ND-CP will be renamed to emphasize its exclusive focus on the lottery. This adjustment follows the removal of earlier provisions linked to insurance, thereby clarifying the law's applicability.

Proposed changes also include a revision of enforcement power structures. The updated inspection system will eliminate certain financial inspectors' authority to impose penalties, aligning it more closely with present administrative frameworks.

Additionally, the draft broadens the authority given to new positions such as heads of inspection teams and senior officials within the finance ministry, granting them the ability to issue warnings, enforce fines, confiscate evidence, and apply corrective actions for any violations.

Provincial leaders, including chairpersons of People's Committees and finance department directors, will also receive enhanced powers. They will be permitted to impose fines, halt operations, and ensure compliance within their areas.

Law enforcement agencies are slated to gain expanded authority through this draft, enabling police and specialized economic and cybercrime units to issue warnings, impose penalties, and act against lottery sector infringements.

These proposed regulations aim to elevate transparency, enhance oversight, and enforce stricter compliance in Vietnam's lottery operations. If accepted, the decree is poised to modernize regulatory practices and improve governance in the sector.
