A US judge has reopened proceedings to investigate whether officials from the Trump administration unlawfully deported numerous Venezuelan men to El Salvador back in March. The inquiry centers around whether these officials bypassed a court directive issued in March to halt the deportations.
US District Judge James Boasberg indicated on Wednesday that he will require sworn statements from the officials to determine if his orders were disregarded. “A factual examination is warranted, and it appears that the best way to advance would be to call in witnesses for oath-bound testimony,” Boasberg mentioned during a status update.
Earlier this year, a federal appeals court had temporarily put the inquiry on hold. However, a larger panel subsequently permitted Boasberg to pinpoint the decision-makers and assess subsequent actions. If officials are found to have violated court orders, the criminal contempt proceedings could result in fines or other repercussions.
Boasberg has instructed the Justice Department to devise a plan by November 24 outlining the forthcoming steps, while attorneys representing the deported individuals were also prompted to share their recommendations. The Justice Department contests Boasberg's jurisdiction, claiming the administration did not intentionally flout any court decrees.
The lawsuit pertains to Venezuelan men deported under the seldom-invoked Alien Enemies Act. In April, Boasberg noted that the Trump administration seemed to act “in bad faith” by swiftly organizing three deportation flights on March 15 while he was evaluating the deportations' legality. The deported men were released from a Salvadoran prison this summer and returned to Venezuela as part of a US-mediated prisoner exchange.
This situation underscores the persistent conflicts surrounding presidential authority, legal boundaries, and immigrant rights within the United States.
