Legal Action Against Binance for Alleged Hamas Support in Terrorism

More than 300 victims and their families impacted by the tragic Hamas attack on October 7, 2023, have initiated legal proceedings against Binance. This cryptocurrency giant, along with co-founder Changpeng Zhao and executive Guangying Chen, is accused of enabling financial transactions that supported Hamas, the militant group accountable for the assaults on Israel.

The assault on October 7 resulted in approximately 1,200 fatalities and the abduction of 250 individuals, igniting a violent conflict that persists to this day. The plaintiffs argue that Binance “knowingly facilitated” hundreds of millions of dollars in cryptocurrency payments linked to Hamas and Hezbollah, both of which the U.S. government recognizes as terrorist organizations.

The lawsuit alleges that over $1 billion in cryptocurrency transactions connected to these groups were made through Binance, financing their operations, including the attacks. The attorney for the victims declared that Binance prioritized profit over compliance with anti-terrorism laws and therefore must be held liable.

This isn't Binance's first encounter with legal issues; earlier in 2023, they admitted guilt in violating anti-money laundering regulations, resulting in a $4.3 billion fine. Zhao briefly stepped back as CEO and served a short prison term, which he was later pardoned for. However, the current lawsuit details more specific allegations about transactions that purportedly continued after Binance's previous guilt admission.

The complaint reveals how Binance served as a haven for illicit activities, reportedly enabling accounts belonging to terrorist groups to transact unhindered on its platform. Additional concerns include a smuggling operation involving gold from Venezuela to Iran, allegedly financing Hamas and Hezbollah.

According to U.S. law, Binance must prevent terrorist entities from accessing the financial system by enforcing rigorous anti-money laundering protocols and reporting suspicious operations. The lawsuit claims Binance deliberately circumvented these duties, allowing terrorists to utilize cryptocurrency transactions unrestricted.

This case stands as one of four similar lawsuits in the United States. The North Dakota case is particularly detailed, specifying digital wallets linked to Hamas, Hezbollah, Palestinian Islamic Jihad, and Iran’s Islamic Revolutionary Guard Corps. Notable individuals are mentioned among deceased, including Hersh Goldberg-Polin, an Israeli-American hostage killed by Hamas, and Itay Chen, an Israeli-American soldier.

A jurisdictional dispute complicates the legal proceedings, as Binance is not U.S.-based. Cases are also pending in New York and Alabama. While a New York judge has allowed the trial to advance, Binance maintains there was no direct involvement in the attacks and argues its services operate on a global scale, unconnected to terror activities.

The outcomes of these lawsuits may profoundly influence how cryptocurrency firms approach security measures and anti-terrorism laws moving forward. Victims and their families are seeking justice, pressing for accountability from Binance and its executives for allegedly enabling financial support to terrorist organizations involved in extreme violence.
