In a striking statement, former President Donald Trump asserted that all official documents signed by Joe Biden via autopen are “null, void, and of no further force or effect.” This assertion, made on Trump’s social media platform Truth Social, has revitalized discussions around presidential power and the utilization of automated signature devices in the White House.
The autopen, a machine that accurately replicates a person’s signature, has been a tool for both Republican and Democratic leaders for many years. Trump, however, criticized Biden for his reliance on it, suggesting that it indicates the president lacks full control over his administration. “Any and all Documents, Proclamations, Executive Orders, Memorandums, or Contracts, signed by Order of the now infamous and unauthorized 'AUTOPEN,' within the Administration of Joseph R. Biden Jr., are hereby null, void, and of no further force or effect,” Trump proclaimed.
He also cautioned that individuals who received pardons or legal documents signed using the autopen should view them as entirely canceled and lacking legal standing. Trump’s remarks come against the backdrop of his continued critiques of Biden’s mental fitness and ability to handle executive duties, frequently referencing the autopen to suggest a delegation of responsibility.
However, Biden’s usage of the autopen aligns with a well-established norm in Washington. Numerous presidents, including Barack Obama and Trump himself, have employed it to expediently sign documents, especially during busy times or while out of the White House. Trump’s assertions are rebuffed by critics, who argue that the autopen does not undermine the legal enforceability of executive orders or other presidential papers.
Moreover, Biden's final hours in office were characterized by several last-minute pardons for notable individuals and family members. These included figures like General Mark Milley, Dr. Anthony Fauci, and congressional members tied to January 6 investigations, as well as Biden's own family. Such clemency measures were perceived as protective actions designed to safeguard allies from potential legal repercussions by the new administration.
Trump’s pronouncement has initiated conversations among legal analysts and political experts regarding the extents of a former president's authority concerning the legitimacy of governmental documents. Despite its symbolic nature, it highlights the profound political schisms and ongoing controversies surrounding executive power in the U.S.
