Groundbreaking Ruling on Emotional Abuse by Singapore Court

In a pivotal ruling, a family court in Singapore has redefined the legal framework regarding emotional and psychological abuse under the nation’s newly updated domestic violence legislation. This case concluded with a personal protection order (PPO) for a woman who left her home with her infant child due to a series of distressing confrontations.

This verdict is one of the inaugural decisions following the amendments to the Women’s Charter, which took effect in 2025. It represents a marked transformation in the legal viewpoint by concentrating on the harm suffered by victims rather than the perpetrator's intent.

Magistrate Allen Chong, in his written judgment, emphasized the need to acknowledge abuse forms that might not result in visible harm but crucially undermine an individual's sense of security. The victim in this case reported experiencing a troubling pattern of conflicts since her marriage in 2024.

The incidents presented included hostile verbal exchanges, aggressive actions like hurling her phone, and a disturbing moment where the husband physically shoved her while she held their child. Although these actions may seem minor individually, they collectively indicated a troubling pattern of intimidation.

A significant piece of evidence was an apology from the husband acknowledging his harmful behavior and admitting to making his wife feel unsafe. The court interpreted this as a clear indication of boundaries being crossed, rejecting the defense claim that the actions were part of typical marital disagreements.

The judgment underscored that the revised law regards emotional and psychological abuse as “harm-focused,” moving away from an “intention-focused” approach. As such, the emphasis lies on the victim's experience rather than the intent behind the abuser's actions.

Following this rationale, the court determined that the woman had indeed faced significant distress, leading to the issuance of the PPO for her protection. Both parties were also instructed to pursue counseling, while the husband has opted to appeal the decision. This ruling is anticipated to serve as a vital reference point for future domestic violence cases in Singapore.
