Washington, Nov 19, 2025: The Trump administration has introduced a contentious proposal that could alter the landscape for immigrants seeking permanent residency in the U.S. The Department of Homeland Security (DHS) has crafted a plan that might restrict green card access for those deemed likely to need government assistance.

Titled "Public Charge Ground of Inadmissibility," the proposed regulation is scheduled for publication today, November 19, with a 30-day period for public comments. If enacted, immigration officers will gain greater discretion in determining whether applicants might become dependent on government benefits like Medicaid, food stamps, or housing aid.

**Evaluation Process**
Under this framework, DHS officials will assess several factors when reviewing green card applications, such as age, health, family dynamics, educational background, financial status, skills, and any previous use of public assistance. They may also examine the Form I-864 Affidavit of Support, which indicates that a sponsor can provide financial support to the applicant.

Matthew J. Tragesser, a spokesperson for U.S. Citizenship and Immigration Services (USCIS), stated, “DHS aims to revoke the 2022 public charge inadmissibility regulations. This proposal reintroduces broader discretion for officers to evaluate relevant facts and aligns with the longstanding principle that individuals in the U.S. should strive for self-sufficiency.”

**Consequences for Immigrants**
This proposed rule undoes protections set in place during the Biden administration that shielded immigrants from penalties related to accessing certain government benefits. Advocacy groups like the Protecting Immigrant Families Coalition and Community Catalyst warn of a chilling effect this change could have on millions of immigrants who rely on essential services, including healthcare and food assistance, making them hesitant to seek the help they need for fear of losing residency opportunities.

Experts indicate that the increased discretion given to immigration officers could lead to more denials, affecting not only new applicants but also current green cardholders if their use of benefits is deemed excessive.

**Connection to Travel Ban**
Reports suggest that this proposal may also connect with ongoing restrictions for nationals from countries under the U.S. travel ban, including Afghanistan, Myanmar, Chad, Iran, Somalia, and Yemen, possibly resulting in stricter evaluations for permanent residency.

**Wider Implications**
The administration defends the initiative as a way to ensure that public resources aren't promoting immigration and that residents maintain their independence. Critics, however, contend that the policy could disproportionately harm vulnerable communities and heighten disparities in accessing healthcare and social services.
