Air Canada has successfully contested a Canadian Transportation Agency (CTA) directive that mandated the airline to compensate a passenger $2,079 for luggage delays.
Federal Court Justice Michael Manson deemed the 2024 ruling unreasonable and has returned the case for reevaluation by a new CTA official.
The issue arose in 2022 when Alaa Tannous and his spouse traveled from Toronto to Vancouver, with their checked bags arriving a day late. Initially, Air Canada offered $250, leading the couple to pursue additional compensation.
Air Canada claimed the CTA's compensation award was exorbitant, highlighting that some purchased items were luxury goods or were acquired after the luggage’s delivery. Justice Manson concurred, stating that the ruling failed to clarify the connection between post-delivery expenses and the luggage delay.
Tannous produced receipts amounting to $3,435, yet only $1,691.98 was for costs incurred prior to the arrival of the luggage. Subsequent purchases included a $433.61 pair of sneakers and a $1,310.40 monogrammed suitcase. Tannous asserted that the sneakers were bought before the luggage was confirmed returned, and the suitcase was intended for replacing the lost items.
The court stressed that the new CTA officer must deliver a reasoned and logical evaluation of the claim, considering what constitutes reasonable expenses for delayed baggage.
As per existing regulations, both passengers and airlines have the right to appeal CTA decisions to the Federal Court to assess the reasonableness of compensation awards.
