Apple has initiated a legal challenge in India regarding the nation's recently enacted antitrust penalty law, which could impose fines up to $38 billion on the tech giant. This lawsuit, filed with the Delhi High Court, represents the first opposition to the 2024 legislation, which allows the Competition Commission of India (CCI) to assess penalties based on a firm's worldwide revenue rather than just its sales in India.
This legal battle comes as Apple has been under investigation by the CCI since 2022 for purportedly misusing its market power in the iPhone app sector. The company has consistently denied any misconduct, and the CCI has not yet issued a final ruling regarding penalties.
In its court submission, Apple contended that the method of calculating penalties based on global turnover is “unjust, unconstitutional, and excessively harsh.” The corporation explained that its “maximum potential fine” under this new regulation, assessed at 10% of its global turnover over the past three fiscal years, could amount to roughly $38 billion. Apple criticized this approach, arguing it unfairly penalizes the company globally for issues confined to India.
Additionally, Apple pointed to the retrospective application of the law as a basis for its challenge. The company claims that the CCI has used the new rules against a violation that happened a decade ago, which it argues is unjust.
Apple highlighted its growth in India while noting its small market share compared to Google’s Android, which leads the local smartphone segment. The tech giant illustrated its argument, stating that penalizing its total worldwide revenue due to actions by a specific division is akin to fining a stationery company based on the revenue of its unrelated toy sector.
The court is set to review Apple's petition on December 3. Legal analysts believe that convincing the court to overturn the law may prove challenging, given the explicit framework allowing the CCI to factor in global revenue when imposing fines.
This case has garnered attention as it tests the boundaries of India’s antitrust legislation and the CCI’s authority to levy significant fines on multinational corporations operating in the country.
