Canada Removes Second-Gen Cut-Off Rule, Eases Path for NRI Families

In a significant change that will affect numerous families of Indian origin, the Canadian government has abolished the controversial “second-generation cut-off” regulation. Bill C-3, aimed at reforming citizenship by descent, has officially received royal assent, representing a pivotal moment for families whose children were denied citizenship solely due to being born outside Canada.

This update positions Canada to broaden the criteria for citizenship by descent, ensuring that families living internationally no longer experience prolonged uncertainty.

Under the new provisions, anyone born prior to the law's implementation, who would have qualified for citizenship had it not been for the previous restriction, will be eligible for citizenship as soon as the bill takes effect. Additionally, Canadian parents born or adopted abroad will now be allowed to pass on citizenship to their children born outside Canada, provided they maintain a significant connection to the country.

The government has stated that this clause regarding “substantial connection” aims to assist global families while preserving the integrity of citizenship. Though the specific implementation date will be announced later, officials have confirmed that temporary measures remain in place until the new law is enacted.

Previously introduced in 2009, the old rule prevented children from obtaining citizenship when their Canadian parents were also born abroad. This created numerous challenges, particularly for Indian-origin families who often manage lives across several countries. Following a court ruling in Ontario in 2023 that nullified this policy, the government decided to seek a permanent solution rather than appeal the court's decision.

By eliminating the enduring cut-off and aligning the law with modern global mobility trends, Canada is poised to provide essential clarity to families who have struggled to navigate convoluted paths to citizenship. This change promises both immediate and long-term relief once the legislation comes into effect.
