Appeals Court Invalidates Trump’s NJ US Attorney Appointment

An appeals court in the US has determined that Alina Habba, previously Donald Trump's personal attorney, was improperly serving as acting US attorney for New Jersey. This ruling poses potential implications for numerous federal criminal cases within the region.

Habba was selected by Trump earlier this year. Following a district court’s rejection of her nomination, the administration appointed her to an acting position without Senate confirmation. On Monday, appellate judges concluded that this action breached the Federal Vacancies Reform Act.

This ruling marks the second instance in which a Trump-appointed US attorney has been disqualified. Judge Michael Fisher highlighted the “legal and political obstacles” facing the administration in appointing its preferred nominees.

Lawyers contesting Habba’s authority described the ruling as significant, noting it as a historic instance where an appeals court curbed a president’s ability to circumvent constitutional and statutory frameworks for placing candidates in critical federal roles.

At 41, Habba joined Trump’s legal team in 2021, notably representing him during the New York hush-money trial that culminated in 34 counts for falsifying business records. Prior to her role as US attorney, she was designated as Trump's presidential counsel, recognized for her allegiance and legal advocacy.

This ruling aligns with a federal judge’s earlier standing earlier this year, favoring three defendants in New Jersey who challenged Habba’s legitimacy.

Recently, other Trump-appointed lawyers faced similar obstructions; interim US attorneys in states like Virginia, California, and Nevada have been disqualified due to legal non-compliance, thereby influencing ongoing federal prosecutions.

Consequently, the Department of Justice may need to appoint a new federal prosecutor in New Jersey to ensure adherence to federal regulations.
