Eminem Takes Legal Action Against Swim Shady for Trademark Infringement

Renowned American artist Eminem (born Marshall B. Mathers III) has initiated a lawsuit against the Australian beachwear brand Swim Shady, asserting that the label's name closely resembles his trademarked persona, Slim Shady.

In September, Eminem submitted a request to the US Patent and Trademark Office seeking the cancellation of Swim Shady’s trademark. Under US regulations, the company has a week to respond to this petition. Eminem’s attorneys argue that the branding causes a “false association” with the artist.

In its defense, Swim Shady plans to protect its intellectual property rights. Launched as Slim Shade in 2023 and starting operations in 2024, the brand specializes in portable beach umbrellas, swim bags, and other accessories. Earlier this year, Swim Shady secured a US trademark just prior to Eminem’s cancellation filing. Moreover, Eminem has also lodged a trademark opposition against the brand in Australia.

Records indicate that Eminem registered the Slim Shady trademark in the US back in 1999 when he released his iconic album. He applied for the Australian trademark in January 2025. Eminem achieved widespread fame in 2000 with his Grammy-winning single “The Real Slim Shady,” which contributed to the distinctive reputation of the Slim Shady name in the rap scene.

Swim Shady asserts itself as an innovative Australian company dedicated to creating stylish and practical sun protection items. The brand has engaged Meyer West IP, a Sydney-based intellectual property law firm, to represent its legal interests.

This legal confrontation is reminiscent of a past Australian trademark conflict between singer Katy Perry and designer Katie Perry, which concluded with the court favoring the latter, illustrating a similar “David versus Goliath” scenario.
