Infant Death Case Results in Mistrial for Mother, Partner Found Guilty

The Ottawa court has ruled a mistrial in the case of Boravy Buth, who faced charges linked to the tragic death of her seven-week-old son in 2021. Meanwhile, her former partner, Patrick O’Connor, was convicted of second-degree murder after a protracted trial.

Both Buth and O’Connor were implicated in the infant's death that occurred in October 2021. Buth also faced charges for criminal negligence resulting in death. However, the jury could not reach a decision regarding her charges, prompting the judge to declare a mistrial, which means her case could be retried in the future.

Emergency services responded early one morning to reports of the baby not breathing at their residence. The trial revealed conflicting stories about the events leading up to the child's distress. Testimonies highlighted discrepancies between what Buth and O’Connor claimed regarding that fateful night.

Crucial medical evidence emerged during the proceedings. A forensic pathologist testified that the infant's injuries were severe and inconsistent with a mere fall from a bed, as suggested initially. The injuries were described as resembling those from a high-impact incident, also raising concerns of potential child abuse. Additionally, signs of previous injuries were noted prior to the tragic event.

In closing statements, both defense teams attempted to place blame on the opposing party, underscoring the case’s intricacies and the conflicting evidence presented to the jury. Ultimately, the jury found O’Connor liable, while Buth's involvement remains uncertain.

Post-verdict, tensions arose in the courtroom, leading to a brief incident involving a relative of the convicted. Court officials and police quickly defused the situation.

O’Connor is set to return for sentencing, while Buth’s legal situation remains ambiguous following the mistrial.
