Hikvision Takes Legal Action Against U.S. FCC Restrictions

In a notable legal development, Hikvision, the prominent Chinese surveillance company, has declared that its U.S. branch is contesting a recent Federal Communications Commission (FCC) regulation that imposes stricter controls on telecommunications products from China. This regulation, designed to address national security worries, prohibits the approval of new devices that include components from firms listed on the FCC's “Covered List” and facilitates the withdrawal of existing authorizations.

The company asserts that the FCC has overstepped its jurisdiction, arguing that the agency is attempting to retroactively limit valid authorizations without adequate legal justification or evidence. Hikvision's petition is intended to protect its business rights and ensure a stable regulatory landscape for compliant firms and customers.

Among those on the Covered List are Hikvision, Huawei, ZTE, China Mobile, and China Telecom, which prohibits these entities from receiving U.S. import or sale approvals for new technology. Recent months have seen major e-commerce platforms eliminate numerous banned listings for products from these Chinese companies, such as home security cameras and smartwatches.

This is not Hikvision's first encounter with regulatory challenges in the U.S. Earlier this year, a federal appeals court denied the company's effort to lift the 2022 prohibition on its new video surveillance and telecom devices. The FCC has also scrutinized other firms, including Hong Kong's HKT, in light of national security risks, indicating heightened vigilance towards foreign telecommunications companies.

Hikvision contends that this legal initiative is crucial for maintaining market equilibrium and defending the interests of partners and consumers in an increasingly complicated regulatory environment.
