Ontario Challenges Ruling on Ford's Personal Call Records

The legal team representing Ontario Premier Doug Ford is contesting a significant transparency ruling that may compel the release of call logs from his personal mobile phone. In court, they argue that the order is based on flawed logic and poses a significant administrative burden for the province.

A panel of three judges convened on Wednesday to hear the Ontario government's appeal against a decision made by the Information and Privacy Commissioner (IPC). This ruling indicated reasonable grounds to believe that Ford utilized his private phone for government conversations.

Advocacy groups for transparency argue that allowing a premier to conduct governmental matters via a personal device without any oversight undermines the principles of open governance and threatens democratic integrity. They contend that Ford should not circumvent transparency obligations merely by using a personal number.

The IPC's ruling in late 2024 was a result of freedom-of-information requests aimed at gaining access to the premier's call logs. The adjudicator determined it was “logical and probable” that Ford dealt with governmental issues on his personal phone, particularly given his practice of publicly sharing his number during events.

The ruling concluded that some calls were likely linked to official duties, thereby making parts of the logs eligible for public record examination. The provincial government swiftly appealed, arguing that the ruling overemphasizes transparency while neglecting the privacy rights enshrined in provincial statutes.

Recently, Ford has noted an influx of incoming calls and has recommended that organizations streamline communications through dedicated contacts. His legal representatives argue that the IPC’s directive is unprecedented and could potentially affect thousands of public employees who occasionally use personal devices for work.
