Ontario Man Fined $70K for Illegal Employment in Banff Hotels

A coordinated effort between the Canada Border Services Agency and the Royal Canadian Mounted Police has culminated in the conviction of an Ontario individual linked to illegal employment in Alberta's Banff area.

On March 2, 2026, Kevin Kielty admitted guilt in the Alberta Court of Justice on two counts concerning the unauthorized employment of foreign nationals. He received a sentence comprising two years of probation, 50 hours of community service, and a monetary penalty of $70,000.

The inquiry was initiated in June 2022 when local enforcement agencies, including the Ontario Provincial Police and Barrie Police Service, exchanged information about potential immigration violations. Investigations uncovered that multiple foreign nationals had traveled from Ontario to Alberta for undocumented work in the hospitality sector, specifically in hotels within Banff National Park.

Further inquiries indicated that approximately 90 workers from Mexico were employed without the necessary authorization at four resort hotels in the Banff and Jasper areas. These operations were reportedly facilitated by Kielty's employment agency, One Team.

Kielty faced charges under the Immigration and Refugee Protection Act for illegally employing foreign nationals and for encouraging unlawful work in Canada. This incident represents his second conviction under this legislation; he had previously pleaded guilty in November 2023 to similar charges, receiving an 18-month house arrest sentence.

Authorities emphasize the significance of inter-agency collaboration in tackling immigration fraud and safeguarding at-risk workers. They caution that such unlawful practices can exploit vulnerable foreign employees and threaten the integrity of the Canadian immigration system.

Gary Anandasangaree remarked that this successful conviction underscores the efficacy of extensive collaboration between federal and provincial bodies in achieving accountability and justice. He acknowledged the diligent work of the investigative team.

CBSA urges the community to report any suspicious immigration activities via its Border Watch Line, highlighting the critical role public awareness plays in deterring such offenses.

In summary, this case stands as a stern reminder that breaches of immigration regulations will be pursued rigorously, reinforcing the importance of fairness and security within the labor market.
