A South Korean special prosecutor has officially sought the death penalty for former President Yoon Suk Yeol, accusing him of orchestrating a coup related to his brief martial law declaration in December 2024. This request emerged during closing arguments at the Seoul Central District Court on Tuesday, marking a historic legal challenge against a former South Korean leader.
During the court proceedings, prosecutors detailed a supposed long-term plot allegedly orchestrated by Yoon and his ex-defence minister, Kim Yong-hyun, which aimed to extend Yoon's tenure unlawfully. They claimed that this conspiracy began in October 2023 and culminated in a shocking declaration of martial law that sparked significant political upheaval.
The special prosecutor maintained that the martial law declaration was not a knee-jerk reaction but rather a result of systematic plotting by key figures in the former administration. The prosecution argued that this plan involved manipulating state institutions and silencing dissent, actions they argue meet the criteria for insurrection per South Korean law.
Though the prosecution has requested the death penalty, it’s noteworthy that South Korea hasn’t executed anyone in nearly three decades. The country has maintained a de facto moratorium on capital punishment, while the death penalty remains on the books for severe offenses like treason.
Yoon, who has denied all accusations, was unavailable for remarks following the hearing. His defense team has asserted that the martial law order was meant to preserve stability and did not constitute a threat to the constitutional order.
The court is set to continue its deliberations before reaching a verdict, with implications that could reshape South Korea’s political scene and the future discourse on capital punishment in the nation.
