California DMV Faces Lawsuit from Immigrant Truck Drivers Over License Issues

Post by : Bianca Haleem

A class-action lawsuit has been initiated by a number of immigrant truck drivers against the California Department of Motor Vehicles (DMV), claiming that state authorities have unlawfully revoked their commercial driver’s licenses, jeopardizing the livelihoods of thousands.

Filed in Alameda County Superior Court, the lawsuit contests California’s recent policy to cancel the licenses of truckers whose legal stay in the U.S. has lapsed. Initially, about 17,000 drivers were notified of pending cancellations last month, a figure that has now escalated to around 21,000.

The Sikh Coalition, a renowned civil rights group, along with the Asian Law Caucus from San Francisco, is representing the affected truckers throughout California, who rely on their commercial licenses for their family support.

The lawsuit asserts that the DMV’s actions breach drivers’ constitutional due process rights by revoking licenses without proper notice, detailed explanations, or fair chances for appeals. The plaintiffs seek a temporary injunction to prevent license cancellations while the matter is pending.

“These drivers have dedicated years to building stable lives and careers in California,” stated Munmeeth Kaur, legal director of the Sikh Coalition. “They are now facing financial ruin through no fault of their own. It is essential for California to protect fairness and adhere to the rule of law.”

These license revocations come amid heightened pressure from the Trump administration, which has increased scrutiny on states like California that grant commercial driving licenses to immigrants. Federal officials have indicated that California, alongside Pennsylvania, Minnesota, and New York, risks losing federal funding for non-compliance with immigration enforcement policies.

California authorities maintain that the licenses were issued with expiration dates tied to the drivers’ authorized status in the U.S., and upon expiration, the state moved to revoke the licenses. However, immigrant advocates argue that many drivers were unaware of the repercussions and relied on their licenses for employment.

The situation has garnered national media attention due to increasing concerns about safety on the roads involving unauthorized drivers. In August, a tragic accident in Florida, attributed to an undocumented truck driver, resulted in three fatalities. Another deadly truck incident in California in October intensified the discourse.

Despite these tragic events, advocacy groups emphasize that revoking licenses without due process unfairly penalizes workers and does not address the broader safety concerns.

The California DMV has refrained from commenting on the lawsuit, adhering to its policy of not discussing ongoing legal matters.
